Welcome to Sultan Stone Capital. These Terms of Service ("Terms") govern your use of our website, applicant portal, and consulting services (collectively, the "Services"). Please read them carefully.
By using our Services, you agree to be bound by these Terms. If you don't agree, please don't use our Services.
Sultan Stone Capital is an operating brand of Sultan Gateway LLC, a Virginia limited liability company. Throughout these Terms, "Sultan Stone Capital," "we," "our," and "us" refer to Sultan Gateway LLC operating under the Sultan Stone Capital brand.
When we say "you" or "your," we mean the individual or business entity using our Services.
Loan brokering services are available only in states where we are legally permitted to operate. Consulting and marketing services are available nationwide. We will inform you if your state restricts the services we can provide.
To use our Services, you must:
Misrepresentation may result in immediate termination of your engagement and possible legal action.
Initial consultations are free and non-binding. We will review your business profile to determine whether loan brokering services may be a fit.
If we proceed, you will provide additional information (tax returns, bank statements, financial statements, etc.) via our secure applicant portal. We will use this information to prepare a loan package and identify lenders likely to approve your application.
We will submit your application to one or more lenders from our panel. We will inform you which lenders we are submitting to. You authorize us to share your business and financial information with those lenders solely for purposes of loan evaluation.
We do not guarantee loan approval, specific loan terms, or specific lender outcomes. Approval is at the sole discretion of the lender. Past results do not guarantee future outcomes.
We receive a commission from the lender when a loan we broker closes. You do not pay us directly for loan brokering services. The commission is paid by the lender out of the loan proceeds or as a separate fee — exact arrangement varies by lender.
We disclose to you, in writing, the existence of our compensation relationship with the lender at the time we submit your application. We do not have exclusive arrangements that would prevent us from acting in your best interest.
Consulting engagements (operations, marketing, financial health) require a signed engagement letter that specifies scope, deliverables, timeline, and fees.
Consulting fees are paid by you directly, as a one-time fee or monthly retainer, processed via Stripe. Fees are non-refundable for work already performed. Refund eligibility for unperformed work depends on the specific engagement terms.
We will deliver consulting outputs (reports, recommendations, plans, etc.) as specified in your engagement letter. Recommendations are advisory only. Implementation is your responsibility.
Unless explicitly stated in your engagement letter, we do not act as a fiduciary. We provide independent professional advice as consultants.

The Sultan Stone Capital brand, name, logo, website content, written reports, consulting deliverables, and platform code are the intellectual property of Sultan Gateway LLC. You may not reproduce, distribute, modify, or create derivative works without written permission.
You retain ownership of all business and financial information you submit to us. By submitting it, you grant us a limited license to use it for the purposes of providing Services to you (including, where applicable, submitting it to lenders on your behalf).
Unless your engagement letter specifies otherwise, consulting deliverables (reports, plans, recommendations) become your property upon full payment of fees. You may not, however, share or sell them as if they were template products for resale.
The Services are provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that you will obtain a loan, that any loan terms will meet your expectations, that your business will succeed, or that our recommendations will produce specific results. Business outcomes depend on many factors outside our control.
To the maximum extent permitted by law, Sultan Gateway LLC's total liability to you for any claim arising out of or related to the Services shall not exceed:
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, lost opportunity, or business interruption.
We are not responsible for the actions, decisions, terms, or outcomes of any lender, vendor, or third party we may introduce you to or refer you to.
You agree to indemnify and hold Sultan Gateway LLC and its officers, members, employees, contractors, and agents harmless from any claim, loss, liability, damage, or expense (including reasonable attorney's fees) arising out of:
You may terminate your engagement with us at any time by giving us written notice. You remain responsible for fees earned through the date of termination.
We may terminate or suspend your engagement for any reason, including breach of these Terms, inability to verify the truthfulness of information you provided, non-payment of fees, conduct we reasonably believe to be unlawful, harmful, or harassing, or cessation of our Services in your state. We will give you reasonable notice when possible.
On termination, your right to use the Services ends immediately. We will return or securely delete your data in accordance with our Privacy Policy (subject to legal retention requirements). Sections that by their nature should survive (intellectual property, limitations of liability, indemnification, governing law) survive termination.
By using our Services, you consent to receive communications from us electronically (email, SMS where you've opted in, in-portal messages). Electronic communications satisfy any legal requirement that communications be in writing.
You may opt out of marketing emails at any time. Transactional emails (account-related, application status, engagement-related) cannot be opted out of as long as you have an active relationship with us.
We may send SMS for status updates or appointment reminders only if you have explicitly opted in. Standard message and data rates may apply. Reply STOP to opt out.
If you have a complaint or dispute with us, please contact us at sultan@sultanstonecapital.com first. We will work to resolve issues informally within 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in Virginia or via videoconference. You waive the right to a jury trial and the right to participate in a class action.
Either party may seek injunctive relief in court for intellectual property infringement, misappropriation of confidential information, or for collection of amounts owed.
You may bring a claim in your state's small claims court if it qualifies, instead of arbitration.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. Any court action permitted under Section 12.3 must be brought in a court of competent jurisdiction in Virginia.
These Terms, along with our Privacy Policy and any engagement letter you sign with us, constitute the entire agreement between you and Sultan Stone Capital and supersede all prior agreements on the same subject.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
Our failure to enforce a provision does not waive our right to enforce it later.
You may not transfer or assign your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business.
We may modify these Terms from time to time. We will post updates with a revised "Last Updated" date. Material changes will be communicated to active clients by email. Continued use of the Services after changes means you accept them.
